Hire Agreement and Safety instructions
This Hire Agreement ("Agreement") is made and entered into by and between Kids Rule Backdrops (“KRB”) and the person/company as stated in the signature section of this Agreement ("the Hirer") collectively referred to as the "Parties."
Please sign this Agreement below to confirm your acceptance of our terms and conditions. If you wish to cancel your hire because you do not agree with any of our terms, please contact us immediately and we will cancel your booking for you as our Numbers unfortunately cannot be hired out without your acceptance of our terms.
1. The Hirer is responsible for any injury or damage occurring whilst the Number(s) is/are on hire to you and we strongly advise you to take note of the safety measures set out herein. Although KRB holds Public Liability Insurance, the Hirer will be responsible/liable for any loss, damage or injury occurring from or as a result of misuse or reckless use whilst on hire. Our terms and conditions are for the safety of all people using this equipment and it is the sole responsibility of the Hirer to ensure they are adhered to. The Hirer is also responsible for any equipment left in a venue overnight which may become damaged or stolen. We advise that all equipment is safely locked away at all times when not in use.
2. In instances where the Hirer is a venue or a professional sub-contractor facilitating the equipment rental for their respective client, it is anticipated that the Hirer will have established their own contractual agreement from their prospective client to cover all of KRB’s terms and conditions.
3. KRB will endeavour to arrive promptly to all bookings. However, on the VERY rare occasion due to high traffic volume, road works or other circumstances beyond our control we cannot guarantee 100% that we will arrive at the exact time requested.
4. Hirers are required to pay any congestion charge fees applicable. If KRB are not advised of the delivery address being in the congestion charge when taking the booking, KRB has the right to charge this fee to the Hirer. Please note, if delivery and collection are on two separate days, the congestion charge will be charged twice.
5. KRB reserve the right to cancel any booking at any time if we feel that the Hirer (or anyone connected to the Hirer) is being abusive or disrespectful to a member of our staff or mistreating our equipment. However, in this event, full payment will still be required.
6. Cancellation of any booking without a minimum of 7 days’ notice will be chargeable at 50% of the total payment due (this is largely due to the Number(s) being reserved especially for you, the Hirer, on your chosen day and therefore we have been unable to hire it to any other Hirer). Alternatively, payment can be used towards a new booking on another date if used within 6 months from the date of the original hire date.
7. Only KRB’s delivery driver is authorised to collect the equipment and under no circumstances (unless prior alternative arrangements have been discussed) should any of the equipment be handed over to anyone other than KRB’s delivery driver.
8. PCN's: When KRB agree in a final confirmation email that payment is to be made as cash on delivery we expect this payment immediately before or after setting up the equipment. Any PCN’s occurred due to wait time for payment will be the responsibility of the Hirer. Therefore, please always ensure that payment is readily available on delivery so that this does not occur. Additionally, PCN's will also be payable by the Hirer if they state at the time of booking that there is free parking available and this is not the case.
9. Usage and Safety: The Client agrees to use the Numbers only for their intended purpose, which is indoor decorative lighting. The following safety instructions must be adhered to at all times:
(a) Do not use as a table or seating: Drinks must not be left on the Numbers and they must not be used as seating.
(b) Indoors only: The Numbers are to be used indoors only. Do not use them outdoors. Covered marquees are permitted but must have a suitable compliant power source and stable flooring.
(c) Stable Placement: Ensure the numbers are placed on a stable surface, away from high traffic areas or locations where they may be easily knocked over.
(d) Secure Wiring: Ensure all plugs and cables are securely in place and kept away from foot traffic to prevent tripping hazards.
(e) Avoid Water Contact: Keep the Numbers away from liquids and damp conditions to prevent electrical hazards.
(f) Proper Power Source: Connect the Numbers only to a properly grounded and suitable power outlet. All electrical plugs provided have been PAT tested for safety.
(g) Supervision: Do not leave the Numbers unattended while they are illuminated.
(h) Children and Pets: Keep children and pets away from the Numbers to prevent accidents.
